This English version is provided for information purposes only. In the event of any discrepancy between the English and French versions, the French version shall prevail. These Terms and Conditions are governed by French law.
Article 1 – Seller Identification

Article 2 – Scope of Application
These Terms and Conditions of Sale (“Terms”) apply to all orders placed by non-professional customers (hereinafter referred to as the “Customer”) through Caroline Venencie’s websites and online sales platforms.
They apply to the following products and services:

Original watercolor paintings

Limited edition fine art prints, signed and numbered

In-person watercolor workshops and classes
-
Online courses and other digital educational content
By placing an order, the Customer acknowledges having read and accepted these Terms and Conditions in full without reservation.
Article 3 – Prices
All prices are displayed in euros (€).
Caroline Venencie operates under the French VAT exemption scheme applicable to artist-authors (Article 293 B of the French General Tax Code). Consequently, no VAT is charged.
Prices may be modified at any time without prior notice. The price applicable to the Customer is the one displayed at the time the order is confirmed.
Article 4 – Orders and Payment
An order becomes final once full payment has been successfully received.
Payments may be made by credit or debit card, bank transfer, or any other payment method made available at the time of purchase.
Payment transactions are processed through the secure payment solutions provided by the sales platform, including Stripe, Wix Payments, or any equivalent secure payment provider.
For online courses, access to the digital content is granted immediately after payment has been successfully confirmed.
Article 5 – Delivery of Original Artwork and Fine Art Prints
Original artworks and fine art prints are shipped within the timeframe indicated on the relevant product page after full payment has been received.
Shipping costs are borne by the Customer unless otherwise stated on the product page.
Every effort is made to display the artwork as accurately as possible. However, colors may vary slightly depending on screen settings or printing conditions. Such variations shall not be considered a defect or lack of conformity.
Article 6 – Right of Withdrawal – Original Artwork and Fine Art Prints
In accordance with Article L221-18 of the French Consumer Code, Customers generally have a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal.
However, the original artworks and fine art prints offered for sale on this website are unique works or products made according to the Seller’s specifications and are clearly personalized.
Pursuant to Article L221-28 (3°) of the French Consumer Code, the right of withdrawal does not apply to such products.
Accordingly, no return or refund will be accepted for original artworks or fine art prints.
If a shipment arrives damaged, the Customer must notify the carrier in writing within two (2) working days of delivery and inform Caroline Venencie by email at contact@caroline-venencie.com within the same period.
Article 7 – In-Person Workshops
Bookings for in-person workshops and classes become final upon receipt of payment.
No refund will be issued in the event of cancellation by the Customer.
However, if the Customer is unable to attend the scheduled workshop, Caroline Venencie will offer the possibility of rescheduling the booking once, subject to availability.
Requests to reschedule must be sent by email to contact@caroline-venencie.com at least forty-eight (48) hours before the workshop begins. Requests received after this deadline cannot be accepted.
Should Caroline Venencie cancel a workshop due to illness, force majeure, or any other exceptional circumstance, participants will be offered either a full refund or the opportunity to transfer their booking to another available date.
Article 8 – Online Courses
The online courses offered by Caroline Venencie are sold through the platform https://caroline-venencie.systeme.io and consist of digital content supplied without a tangible medium. Access to the course is provided immediately after payment has been confirmed.
In accordance with Article L221-28 (13°) of the French Consumer Code, the right of withdrawal does not apply to digital content supplied without a tangible medium once performance has begun following the Customer’s prior express consent and express acknowledgment that the right of withdrawal is waived.
By confirming the order and ticking the checkbox provided before completing the purchase, the Customer expressly requests immediate access to the course and acknowledges waiving the right of withdrawal in accordance with Article L221-28 (13°) of the French Consumer Code.
No refund will be granted once access to the course has been activated, except where required by mandatory provisions of applicable law.
Article 9 – Intellectual Property
All artwork, illustrations, photographs, videos, course materials, texts, downloadable resources, and other content displayed or made available by Caroline Venencie are protected by French and international copyright and intellectual property laws.
The purchase of an original artwork, fine art print, online course, or any other product does not transfer any intellectual property rights to the Customer.
No artwork, image, video, lesson, PDF, or other educational material may be reproduced, copied, distributed, shared, published, modified, sold, or used for commercial purposes without the prior written consent of Caroline Venencie.
Access to online courses is granted solely for the personal, private, and non-transferable use of the Customer. Sharing login credentials or course content with third parties is strictly prohibited.
Article 10 – Legal Guarantees
The products sold through Caroline Venencie’s websites benefit from the legal guarantees provided under French law, including the legal guarantee of conformity and the legal warranty against hidden defects, where applicable.
Nothing in these Terms and Conditions shall limit or exclude any mandatory statutory rights granted to consumers under applicable law.
Article 11 – Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of France.
In the event of a dispute, the parties shall seek an amicable resolution before initiating legal proceedings.
Failing an amicable settlement, the dispute shall fall within the jurisdiction of the competent French courts, unless otherwise required by mandatory provisions of applicable law.
Article 12 – Personal Data
Personal data collected in connection with orders and customer accounts are processed in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable French data protection legislation.
Personal data are used solely for the purposes of processing orders, providing customer support, delivering purchased products and services, and complying with legal obligations.
